नेपालमा तेस्रो लिंगीहरुले आफ्नो लैंगिक पहिचानका आधारमा नागरिकता, राहदानी लिन सक्छन् । तर, सामाजिक शिक्षा अध्यापन गराउने विद्यालयदेखि समाजशास्त्रमा उच्च शिक्षाका उपाधि दिने विश्वविध्यालयले भने तेस्रो लिंगीलाइ चिन्दै चिन्दैनन् ।
परिवारमा छोराका रूपमा जन्मिएका क्रोजन कपाली, हुर्किँदो उमेरसँगै उनमा महिला स्वभाव विकास भयो । नाम पनि रुक्सना कपाली बनाइन् । आफ्नो भिन्नै हाउभाउका कारण विद्यालयमा साथीभाइ तथा शिक्षकबाट मानसिक र शारीरिक यातना भोगेकी उनले सोही यातना फेरि खप्नु नपरोस् भनेर आफ्नो पहिचान लुकाएर १२ कक्षा सकिन् । जब उनी उच्च शिक्षाका लागि त्रिभुवन विश्वविद्यालय पुगिन् । भर्नामा त खासै अप्ठ्यारो भएन। जब रेजिष्ट्रेसनको समय आयो, विश्वविद्यालय नै अन्योलमा पर्यो । किनभने एसएलसीमा उनी पुरूष थिए भने १२ पढ्दा महिला । नागरिकतामा भने तेस्रो लिंगी जनाइयो । राष्ट्रले एकातिर लैङ्गीक पहिचान अनुरुप नागरिकता त उपलब्ध गरायो तर शैक्षिक क्षेत्रमा भोग्नुपर्ने समस्यातर्फ ध्यान नपुर्याएको उनले बताइन् । पहिचान नखुलाउँदा शारीरिक स्वरूप र हाउभाउका कारण साथीभाइ तथा शिक्षकबाट अपशब्द र दुर्व्यवहार खेप्नुपर्ने । पहिचान खुलाए त्यसअनुसार शैक्षिक प्रमाणपत्र नै नपाइने भएकाले धेरैले बीचैमा पढाइ छाडेका छन् । शारीरिक बनावट परिवर्तन भएकाले पुरानो फोटोसँग नमिलेको भन्दै विश्वविद्यालयका परीक्षाबाटै निष्काशित हुनुपरेको देखि लोक सेवा आयोगको परीक्षामा सामेल नै हुन नपाएको अनुभव समेत कतिपय तेस्रोलिंगीसँग छ । कुनै व्यक्तिको शारीरिक अवस्था विशेषकै कारणले शिक्षा वा अन्य अवसरबाट वञ्चित गराउने कानुनी र संरचनागत समस्या कायमै रहनु समावेशी लोकतन्त्रका निम्ति सुहाउने विषय होइन । त्यसैले बिना भेदभाव, उच्च मनोबलसहित उच्च शिक्षा हासिल गर्न र सार्वजनिक सेवामा प्रवेश पाउने अवसर विश्वविद्यालयदेखि राज्यका अन्य निकायले सुनिश्चित गर्नुपर्छ ।
